Zharrin Frankie Simmons v THE QUEEN The appellant Zharrin Simmons, along with two male persons, was convicted on two counts of robbery. The first count related to Kenneth Williams and the second to Victoria DeCoute. She was sentenced to five years imprisonment on each count, the sentence to run concurrent. On 27th August 2011, at about 8 p.m. Kenneth Williams along with Victoria DeCoute, left Miss DeCoute mother’s house in Pembroke driving in her mother’s car. Miss DeCoute was in the passenger seat. 3. 4. 5. 6. 7. 8. 9. The car was driven to Hermitage Road in Devonshire. On arrival there, Mr. Williams parked the car in a parking lot outside of SAL. He said it was dark but there were streetlights there. They had gone there to purchase marijuana. Miss DeCoute contacted the person they were going to meet. About five minutes later, Mr. Williams testified, that he saw a man come towards the parked car. The man came to the driver’s side of the car. The window was down; the door was closed but not locked. Another man came towards the car and the first man opened the driver’s door. He had a knife in his right hand and he tried to stab Mr. Williams around his head and chest area. Mr. Williams tried to grab the knife. The second man was attempting to punch him in his face.

Tracey Pitt v THE QUEEN Respondent/Appellant TRACEY PITT Baker, JA: Tracey Pitt was tried in the Supreme Court before Wolffe AJ and a jury on an indictment containing six counts. On 10 September 2013 she was acquitted of counts 1 and 3, causing grievous bodily harm when driving a vehicle whilst impaired by alcohol and count 5 driving a vehicle while under the influence of alcohol. She was convicted of counts 2 and 4, reckless driving contrary to section 320 of the Criminal Code and count 6, failing or refusing to provide a specimen of breath contrary to section 35C(7) of the 2. 3. 4. 5. Road Traffic Act 1947. She was sentenced to 3 months imprisonment concurrent on each count and on count 6 was also disqualified for 18 months with 8 demerit points. On 19 March 2014 we allowed her appeal against conviction on counts 2 and 4 and dismissed her appeal against conviction on count 6. We allowed her appeal against sentence on count 6 to the extent of varying her sentence by vacating the 3 month sentence of imprisonment and reducing the
