MARINE AND PORTS AUTHORITY (PORT DUES) REGULATIONS 2023

conferred by section 40 of the Marine and Ports Services Act 2021, makes the following Regulations:
Citation
1 These Regulations may be cited as the Marine and Ports Authority (Port Dues) Regulations 2023.
Liability
2 Port dues shall be payable pursuant to these Regulations in respect of every ship, other than a ship referred to in section 27(2) of the Marine and Ports Services Act 2021, within the territorial waters of Bermuda lying moored, or at anchor, or at any dock or shore.
3. Rate
(1) Port dues payable under these Regulations in respect of any ship shall be at the rate of $648 up to 100 metres length overall and $15.05 per metre or part in excess of
100 metres as stated—

(a) subject to paragraph (3) the port dues payable on a ship at anchor or at a mooring buoy or at the Esso Oil Terminal shall be at the above rate for each day or part of a day; and
(b) the port dues payable on a ship at any dock owned by the Government or a municipality shall be at the above rate for each visit.
(2) For the purposes of these Regulations a day shall be calculated as a period of
24 hours from the time the ship has completed anchoring, mooring or berthing alongside.
(3) Notwithstanding paragraph (1)—
(a) after any 24 hour period has been completed, port dues in respect of a further 24 hour period shall not be charged unless a two-hour excess period has been exceeded; and
(b) where full port dues have been paid for 10 consecutive days, the Authority may, if it considers it appropriate so to do, reduce further port dues by an amount not exceeding ten per cent of the amount which would be chargeable under these Regulations.
4. Payment
(1) The port dues payable pursuant to these Regulations shall be paid by the owner, master or agent of the ship on demand of the Director of Marine and Ports Services or of any person authorized by him in writing to receive the demand.
(2) The port dues payable pursuant to these Regulations for each day or part of a day or visit, as the case may be, shall, if so demanded as provided, be payable during the day or part of a day on which the demand is made.
Revocation
5 The Marine and Ports Authority (Port Dues) Regulations 1969 are revoked.
Commencement
6 These Regulations shall come into force on 1 April 2023.
