LEGAL EXECUTIVES (REGISTRATION) REGULATIONS 2013

Registration Council, makes the following Regulations:

Citation

1 These Regulations may be cited as the Legal Executives (Registration) Regulations

2013.

Interpretation

2 In these Regulations—

“the Council” means the Legal Executives Registration Council established by section 4 of the Legal Executives (Registration) Act 2011 (“the Act”);

“foreign register” means a register of legal executives kept and maintained by the Institute of Legal Executives of England and Wales or any person acting under the authority of the Institute in any country or place outside Bermuda;

“legal executive diploma” means any diploma, degree, fellowship, membership, licence, authority to practise, letters, testimonial, certificate, or other status of document granted by the Institute of Legal Executives of England and Wales, or under the authority of the Institute in any country or place outside Bermuda;

“the Register” means the Register of Legal Executives maintained by the Registrar- General under section 6 of the Act.

Application for registration

3 An application for registration as a legal executive under section 8 of the Act shall be made to the Registrar-General in Form A in the Schedule.

Documents in support

4 The following documents shall be forwarded by an applicant to the Registrar- General with an application for registration—

(a) the originals of all legal executive diplomas awarded to the applicant, or copies of such diplomas certified as true copies by or on behalf of the authorities by which the original diplomas were respectively awarded;

(b) where the applicant is registered as a legal executive in any country or place outside Bermuda, a copy of the relevant entry or entries in that foreign register certified as a true copy by the authority which keeps and maintains the foreign register;

(c) a certificate or testimonial of the character of the applicant given within the period of three months last preceding the date of the applicant by a person of standing and responsibility well acquainted with the applicant;

(d) a statement by the applicant of his experience as a legal executive up to the date of the application;

(e) a certificate or testimonial of the professional competence of the applicant as a legal executive by a legal executive or barrister and attorney of standing and responsibility well acquainted with the applicant’s work.

Entries in the Register

5 The following particulars relating to each legal executive shall be entered in the Register—

(a) his name and professional address;

(b) the date of award to him of each professional qualification;

(c) the date of the entry of the name and particulars.

Form of certificate of registration

6 A certificate of registration shall be in Form B in the Schedule.

7. Additional particulars may be entered

(1) Application by a registered legal executive to have entered in the Register particulars of any degree, diploma or other qualification which was awarded after his registration shall be made to the Registrar-General in Form C in the Schedule.

(2) Such an application shall be supported by the originals of any such degree certificate, diploma or other qualification, or copies certified as true copies by or on behalf of the authorities by which the degree, diploma or qualification was awarded.

Service of documents

8 Any application, notice or other document which is required or authorised under the Act to be made or given to, or served on, any person may be made, given or served—

(a) by delivering it to that person; or

(b) in the case of the Registrar-General or the Council, by leaving it or sending it in a prepaid letter addressed to the Registrar-General or, as the case may be, the Chairman of the Legal Executive Registration Counsel at the office of the Registrar-General; or

(c) in the case of any person, by leaving it or by sending it in a prepaid letter addressed to him, at his usual or last business residence.

Commencement

9 These Regulations come into operation on the day the Legal Executives (Registration) Act 2011 comes into operation.

9. Particulars (if any) of striking off or removal from any legal executive register, or of any
10. disciplinary action taken by any legal executive authority.
