HAMILTON PUBLIC ENTERTAINMENTS (CONTROL) ORDINANCE 1928

BX 1 / 1928

[made under section 38 of the Municipalities Act 1923 and brought into operation on 17 March 1928]

1 This Ordinance may be cited as the Hamilton Public Entertainments (Control) Ordinance 1928.

Licence required for place of public entertainment

2 No person shall use any building in Hamilton as a theatre, dance hall, concert hall or for any public exhibition, entertainment or performance without a licence from the Corporation of Hamilton, who shall first consult with the Chief Fire Officer as regards fire safety measures.

Conditions in licence

3 The licence may prescribe—

(a) the number of persons to be allowed in the building during any performance;

(b) the means of egress and ingress;

(c) precautions, including fire precautions, to be taken to provide for the safety of persons using the buildings; and

(d) such other conditions as are deemed necessary by the Corporation for the safety of the persons attending any such performance.

Suspension; cancellation

4 Any such licence may be suspended or cancelled at any time by notice from the Corporation; and during such time as any licence is suspended or cancelled, any person using the building for which such licence was granted for any public exhibition, performance or entertainment shall be liable to be prosecuted.

Public morality; public good

5 If in the opinion of the Mayor of Hamilton any public exhibition, entertainment or performance being held or proposed to be held in Hamilton is contrary to public morality or the public good, the Mayor may stop or prohibit such exhibition, entertainment or performance.

Offences

6 A person convicted of an offence against this Ordinance shall be liable to the punishment prescribed by section 46 of the Municipalities Act 1923 [title 4 item 1].
