QUOFATAFERUNT BERMUDA COST OF LIVING (ESSENTIAL COMMODITIES) AMENDMENT REGULATIONS 2026 BR 51 / 2026 The Minister responsible for consumer affairs, in exercise of the power conferred by section 10E of the Cost of Living Commission Act 1974, makes the following Regulations: Citation

1 These Regulations which amend the Cost of Living (Essential Commodities) Regulations 2022 may be cited as the Cost of Living (Essential Commodities) Amendment Regulations 2026. Inserts new regulations 7A and 7B

2 After regulation 7 insert—

7A. “Commission may require regular real-time price information

(1) Without prejudice to the foregoing provisions, the Commission may by separate notice in writing require a business undertaking that sells or otherwise deals in any essential commodity listed in the Schedule to these Regulations to regularly furnish the Commission with any price changes for that essential commodity and to require such information within a period not exceeding 24 hours from the change in price.

(2) A notice issued under paragraph (1) shall require such price information to be furnished via—

(a) electronic mail;

(b) secure electronic data transmission; 1 COST OF LIVING (ESSENTIAL COMMODITIES) AMENDMENT REGULATIONS 2026

(c) digital web-based data entry using systems provided by the Commission; or

(d) any other electronic or digital means as the Commission considers appropriate.

(3) When issuing a notice under this regulation, the Commission shall—

(a) take into consideration the size and capacity of the business undertaking to whom the notice applies;

(b) where necessary, offer technical guidance and assistance specific to the means by which the information is required to be furnished to the Commission; and

(c) give the business undertaking a reasonable period of time within which to adopt the requisite electronic or digital means for furnishing price information. Digital web-based application platform for furnishing real-time price information

7B.

(1) In the case of any notice to which regulation 7A(2)(c) applies, the Commission shall specify in that notice—

(a) the digital web-based application platform to be used for the furnishing of price information;

(b) that the price information furnished will appear on a secured shared digital database for real-time public access; and

(c) any additional information about the operation and functionality of the digital web-based application platform as the Commission considers necessary.

(2) Subject to paragraph (3), a business undertaking to whom this regulation applies shall meet the costs of furnishing price information using the digital web-based application platform specified.

(3) A business undertaking that cannot provide price information by means of a digital web-based application platform may—

(a) request assistance from the Commission in writing; and

(b) state in the request for assistance the reasons for its inability to furnish the information by the means specified.

(4) Where the Commission is satisfied that the business undertaking requesting assistance under paragraph (3) has—

(a) given adequate reasons for its inability to furnish the information as required; and

(b) demonstrated that it employed all the means at its disposal to comply with the requirement to furnish the information, 2 COST OF LIVING (ESSENTIAL COMMODITIES) AMENDMENT REGULATIONS 2026 the Commission may assist the business undertaking in furnishing the information or enable the information to be furnished by other means under regulation 7A(2).”. Revokes and replaces regulation 8

3 Revoke regulation 8 and replace it as follows—

“Publishing of price information on essential commodities

8 The Commission shall publish information on the prices of essential commodities on a weekly basis or such shorter period, including in real-time, and in such manner as the Commission may determine as appropriate, including by way of a secured shared digital database with real-time public access for the purpose of notifying members of the public.”. Revokes and replaces the Schedule

4 Revoke the Schedule and replace it as follows—

“SCHEDULE (regulation 3) ESSENTIAL COMMODITIES The essential commodities to which these Regulations apply are as follows—

1 Fresh produce Apples, Avocados, Bananas, Beans, Berries, Carrots, Grapes, Green Beans (canned and fresh), Lemons, Limes, Mixed greens, Onions, Oranges, Potatoes, Pumpkin, Sweet potatoes

2 Meats Canned Tuna, Chicken, Deli Meats, Frozen Fish, Frozen Turkey Parts, Ground Beef, Ground Turkey

3 Eggs and Dairy Eggs, Butter, Canned Milk, Cheese, Cottage Cheese, Milk, Yogurt

4 Bakery, Cereal and Grains Bread, Corn Flakes, Crackers, Flour, Hot cereals (Quaker Oats, cornmeal and Cream of Wheat), Muesli, Oats, Pasta, Quinoa, Rice, Rice Krispies

5 Pantry Staples Baking soda, Canned Vegetables, Chickpeas, Jam, Lentils, Nuts, Oil, Peanut Butter, Pepper, Salt, Soups, Spaghetti Sauce, Stock

6 Infant Nutrition and Care Baby food, Baby wipes, Children’s Medicines, Formula, 3 COST OF LIVING (ESSENTIAL COMMODITIES) AMENDMENT REGULATIONS 2026 Napkins and Napkin Liners for Babies (Diapers)

7 Household Cleaning and Hygiene Bath Soap, Bleach, Dish Detergent, Laundry Detergent, Lotion, Paper Products, Sanitary Towels (Pads) and Tampons, Soap, Toothpaste ”. Made this 8th day of May 2026 Minister of Home Affairs
