9 Offence The Minister responsible for marine and ports services, in exercise of the power conferred by section 12(1)(a) and (b) of the Marine and Ports Services Act 2021, and paragraph 4 of the Marine Board (Declaration of Speed Limits for Boats) (Mariners) Notice 2001, issues the following Notice: Citation

1 This Notice may be cited as the Marine and Ports Services (Mariners) (Offshore Power Boat Races) Notice 2026. Interpretation

2 In this Notice— “boat” includes a personal water craft, commonly referred to as a jet-ski and “boatman” includes a person who operates a personal water craft; 1 MARINE AND PORTS SERVICES (MARINERS) (OFFSHORE POWER BOAT RACES) NOTICE 2026 “Ferry Reach” means all that area of water from the airfield landing light pylons close to the Bermuda Institute of Ocean Sciences thence westward along the Reach to a line extending from the north side of the Reach to Little Rogue Island thence to the eastern edge of Rogue Island thence south-eastwards to Stone Crusher Corner at Kindley Field Park; “power boat race” means a closed circuit power boat race. 3 The Offshore Power Boat Races (“the Races”) will be held in between the hours of 10:00 a.m. and 5:00 p.m. at Ferry Reach on the following dates—

(a) Sunday, 3 May 2026;

(b) Sunday, 17 May 2026;

(c) Sunday, 7 June 2026;

(d) Sunday, 19 July 2026;

(e) Sunday, 13 September 2026;

(f) Sunday, 11 October 2026. Closure of certain areas

4 The passage between the pylons at the entrance to Ferry Reach will be closed to normal marine traffic during the dates and times specified in paragraph 3. Courses for the Races

5 The courses for the Races will be from Ferry Reach following a prescribed course determined on the day and thence back to Ferry Reach. Practice races

(1) Practice races will be held weekly on Tuesday, Thursday, Saturday and Sunday commencing Tuesday, 7 April 2026 through Saturday, 31 October 2026 between the hours of 12:00 p.m. and 6:00 p.m.

(2) The provisions of this Notice (except paragraph 7(1)) apply in all respects to practice races held on the days provided for in this paragraph as they apply to power boat races held on the dates provided for in paragraph 3. Patrol of course

(1) Ferry Reach will be patrolled by the Bermuda Royal Regiment coast guard unit and marshal boats during the power boat races referred to in paragraph 3, but not during the practice races.

(2) All mariners, pilots and boatmen are required to exercise extreme caution in approaching Ferry Reach whether or not Ferry Reach is being patrolled. 2 MARINE AND PORTS SERVICES (MARINERS) (OFFSHORE POWER BOAT RACES) NOTICE 2026 Non-application of speed limits

(1) The speed limits fixed by paragraph 3 of the Marine Board (Declaration of Speed Limits for Boats) (Mariners) Notice 2001, shall not apply to boatmen participating in the Races referred to in paragraph 3 of this Notice.

(2) Members of the Bermuda Power Boat Association must display a valid registration number at all times. Offence

9 It is an offence under section 12(5) of the Marine and Ports Services Act 2021 for a mariner, pilot or boatman to fail to observe the requirements of this Notice, punishable on summary conviction in accordance with section 84 of that Act.
