Citation
1 These Regulations may be cited as the Optometrists and Opticians Regulations
2010.
Interpretations
2 In these Regulations—
“Act ” means the Optometrists and Opticians Act 2008.

Application for Registration
3 Applications by a person to be registered under the Act shall be made to the Registrar in Form A in the Schedule.

Documents in support
4 The following documents shall be forwarded by an applicant to the Registrar, with an application to be registered under the Act—
(a) the originals of all professional diplomas awarded to the applicant, or copies of the diplomas certified as true copies by or on behalf of the authorities by which the original diplomas were respectively awarded;
(b) in any case where the applicant is registered as an optometrist or optician in any country or place outside Bermuda, a certified copy of the proof of registration by the registering authority of that country;
(c) a certificate or testimonial of the character of the applicant given within the period of three months last preceding the date of the application by a person of standing and responsibility well acquainted with the applicant;
(d) a statement by the applicant of his experience in the practice of optometry up to the date of the application;
(e) a certificate or testimonial of the professional competence of the applicant in the practice of optometry given by an optometrist or optician of standing and responsibility well acquainted with the practice of the applicant.

Entries in the register
5 Where the name and professional qualifications of an applicant are to be entered in the register, there shall, together with such information, be entered the following—
(a) the residence of the applicant;
(b) the date of award of each professional qualification of the applicant;
(c) the date of the entry of the name and particulars of the applicant in the register.
Certificate of Registration
6 A certificate of registration shall be in Form B in the Schedule.
Additional particulars may be entered
7 An application by a registered person to have particulars of any other qualifications entered in the register shall be made to the Registrar in Form C in the Schedule.

8. Continuing professional education
(1) A registered optometrist shall complete 24 hours of approved continuing professional education during the time period required in section 8(2)(b) of the Act.
(2) A registered optometrist authorised to prescribe therapeutic pharmaceutical agents shall complete an additional 16 hours of approved continuing professional education during the time period required in section 8(2)(b) of the Act.
(3) A registered optician shall complete no less than 20 hours of approved continuing professional education during the time period required in section 8(2)(b) of the Act.

(5) A registered person who exceeds the number of hours of continuing professional education in a registration period shall be permitted to carry forward a prescribed number of hours of continuing professional education into the next registration period.
(6) All continuing professional education shall have prior approval of the Council.
(7) Approved continuing professional education shall consist of any course characterized by the issuance of a certificate documenting attendance or completion of—
(a) a designated seminar or course;
(b) an online course, a mail correspondence course or a pre-recorded media course; or
(c) any other course format approved by the Council.
(8) The certificate referred to in subsection (7) shall include—
(a) the registered person’s name;
(b) the course title;
(c) the name of the organization or individual giving the course;
(d) the date and location of the course;
(e) the number of hours completed; and

Service of documents
9 Any application, notice or other document which is required or authorised under the Act to be made or given to, or served on, any person may be made, given or served—
(a) by delivering it by registered mail to that person;

(b) in the case of the Registrar or Council, by leaving it with, or sending it to the Chairman of the Council at the Ministry of Health; or
(c) in the case of any other person, by leaving it at, or sending it to their usual or last business address.

Administering anti-glaucoma medication
10 A registered optometrist shall consult with an ophthalmologist when providing treatment with anti-glaucoma medication if—
(a) the glaucoma progresses despite the use of two glaucoma medications;
(b) more than two medications are required to control the glaucoma; or
(c) secondary glaucoma develops.
