BERMUDA

NURSING AND MIDWIFERY RULES 2010

BR 53 / 2010

1 These Rules may be cited as the Nursing and Midwifery Rules 2010.

Definitions

2 For the purposes of the Nursing Act 1997 and these Rules—

“advanced practice nurse” means a general nurse who—

(a) has acquired an expert knowledge of nursing, at a minimum at the level of a graduate degree in nursing;

(b) has acquired the skill to make complex decisions in the nursing field;

(c) has the clinical competencies to make diagnoses of patients and prescribe treatment for patients, in collaboration with a medical practitioner; and

(d) is registered as an advanced practice nurse;

“general nurse” means a person who—

(a) is qualified in nursing by virtue of having graduated from an approved or accredited nursing education program that is recognized by the Council; and

(b) is licensed or registered as a registered nurse (“RN”) in Bermuda or in another jurisdiction that is recognized by the Council;

“midwife” means a person who—

(a) has completed a midwifery education programme that is duly recognized by the Bermuda Nursing and Midwifery Council;

(b) has acquired requisite qualifications to be registered in Bermuda or a jurisdiction recognized by the Bermuda Nursing and Midwifery Council;

“nurse specialist” means a registered general nurse who—

(a) has a graduate degree in nursing and practises in a particular branch of nursing such as clinical nursing, psychiatric nursing, nursing administration, teaching or consultancy; and

(b) is registered as a specialist nurse in Bermuda or in another jurisdiction that is recognized by the Council;

“nursing associate” means a person who—

(a) is qualified to assist a nurse in caring for persons by virtue of having obtained a certificate in nursing care from an institution that is recognized by the Council; and

(b) is registered as a nursing associate in Bermuda or in another jurisdiction that is recognized by the Council;

“temporary nurse, midwife or nursing associate” means a person who—

(a) holds such qualifications and experience as the Council may deem appropriate in any one of the following categories—

(i) nursing;

(ii) midwifery; or

(iii) nursing associate;

(b) is registered by the Council as a temporary nurse, midwife or nursing associate in the category applicable to the person for a period not exceeding

120 days; and

(c) is able to provide such temporary assistance as a nurse, midwife or nursing associate during the period of registration as the Council may specify under such conditions as the Council may determine with respect to each category referred to in paragraph (a). 3. Register

(1) The register shall set out the particulars referred to in paragraph (2) and shall consist of divisions as follows—

(a) the nurses and nursing associates division, which shall be divided into parts as follows—

(i) Part A, which shall contain a list of the names of persons who are registered as nurse specialists;

(ii) Part B, which shall contain a list of the names of persons who are registered as general nurses;

(iii) Part C, which shall contain a list of the names of persons who are registered as advanced practice nurses;

(iv) Part D, which shall contain a list of the names of persons who are registered as nursing associates; and

(b) the midwives division;

(c) the temporary nurse, midwife or nursing associate division, which shall contain a list of the names of persons who are registered as temporary nurses, midwives or nursing associates with respect to the applicable category of nursing, midwifery or nursing associate.

(2) The register shall, in addition to the provisions of section 4(2) of the Act, set out—

(a) the full name and address of the registered person;

(b) the person’s qualifications;

(c) the branch or branches of nursing practice in relation to which every person is registered and any specialty; and

(d) the date of the person’s registration. [Rule 3 revoked and substituted by BR 150 / 2018 rule 4 effective 21 December 2018; Rule 3 paragraph

4. Applications

(1) An application under section 5 of the Act for a registration certificate or under section 6 of the Act for renewal of a registration certificate shall be accompanied by—

(a) the originals, or copies certified by a notary public, of any professional qualifications mentioned in the application;

(b) copies of any other documents relating to professional qualifications, experience and character which are to be relied on for the purposes of the application.

(2) Other applications under the Act shall be accompanied by the originals, or copies certified by a notary public, of any documents that are to be relied on for the purposes of the application.

Number of practice hours

5 For the purposes of section 6(3)(b) of the Act, the number of hours prescribed are not less than 100 hours of practice per year as a general nurse, nurse specialist, advanced practice nurse, nursing associate or midwife, as the case may be.

Continuing education requirements

6 For the purposes of section 6A of the Act, the number of hours of continuing professional education that must be completed in every period of two calendar years is 24 hours.

Revocation

7 The Nursing Rules 2003 are revoked.
